SMEICORP offers for sale lingerie, clothing, wellness products and associated accessories (hereinafter referred to as "Products") to Customers, who are natural persons wishing to acquire the Products for strictly personal use, and in particular to the exclusion of any resale to third parties. Any order for the Products offered on the Site is subject to the express and unreserved acceptance of these general conditions of sale.
These general conditions are intended to define the terms and conditions of the online sale of Products through the Site as well as the obligations of each of the parties.
These apply to the exclusion of all other documents. In the event of contradiction between the terms of the general conditions of sale and the terms of any other document (in particular estimate, invoices, letters of any kind, summary of the orders…), the terms of the general conditions of sale will prevail. Certain Products mentioned on the Site may be subject to specific conditions to which the customer must refer and which are an integral part of these general conditions of sale.
2-1. Terms of Access
In order to be able to place an order on the Site, the Customer must have a microcomputer and telecommunications means enabling him to connect to the Internet. The Customer must also have an e-mail address, either directly or through a service provider or a service provider with Internet access. The products available on the Site are reserved for natural persons, adults, excluding any sale to professionals or for the purpose of resale to third parties. The current price is that appearing on the Site on the date of the order placed by the Customer, SMEICORP reserving the right to modify the price of the Products at any time. SMEICORP does not guarantee the resupply times for the Products indicated on the Site. In the event of delay, SMEICORP will inform the Customer on the Site or by email sent to the Customer's email address. The displayed prices of the Products are indicated in euros, VAT included. The prices indicated do not include the processing and shipping costs which will be invoiced in addition and specified to the Customer in the order summary before the validation of the order. All prices are given subject to manifest typographical error. Promotional offers are only valid within the double limit of the period of validity of the offer concerned and available stocks. Any advantage cannot be combined with other advantages (e.g. coupons, sales, promotions).
Special case of Switzerland and countries and territories outside the European Union. The sales prices are calculated without French VAT (excluding all taxes).
Each shipment from abroad is subject to import taxes and VAT. When sending by post, the customer is considered to be an importer and is obliged to pay the accumulated taxes.
The customer undertakes, under his sole responsibility, to comply with the local taxation rules which apply to him and to obtain prior information from the Customs Administration of his country regarding the amount of taxes and the nature of the goods he wishes to import.
We provide customs documents for all packages destined for abroad. These documents summarize the total value of the content of your order and the nature of the goods.
By checking the box "I agree to pay for my order and I acknowledge having read the general conditions of sale and I declare that I accept them without reservation", the Customer confirms his order and, therefore, accepts without reservation all of these general conditions of sale. This confirmation and all of the data that SMEICORP has recorded will constitute proof of the transaction.
SMEICORP reserves the right to cancel any order in the event of (I) an order for a high number of items or an amount greater than 200 euros, (II) of an existing dispute with the Customer, (III) of no - total or partial payment of a previous order by the Customer, (IV) refusal to authorize payment from banking organizations, (V) refusal to accept payment for our fraud detection system, (VI) non-payment within seven days of the order (VII) for partial payment or (VIII) in the event of an error in the calculation of prices and weights. SMEICORP cannot in any case be held liable in these cases.
In case of cancellation of the order by SMEICORP, SMEICORP will send by email to the Customer an acknowledgment of receipt, invalidating the order, as soon as possible.
In addition, the Customer has the possibility of consulting the status of his orders, exchanges and returns on the Account which he will have created on the Site (hereinafter called "My Account").
By validating his order, the Customer undertakes to pay for it.
When the conditions necessary for registration are met, the Customer can access his "Account" using his login details. This information is strictly personal and confidential and must not be communicated or shared with third parties. In no case SMEICORP can not be responsible for the loss of its login credentials by the Customer.
The Customer will be solely responsible for the use of his login identifier by third parties or for actions or declarations made through his "Account", whether fraudulent or not. It guarantees SMEICORP against any request in this respect. In addition, SMEICORP does not have the means to ascertain the identity of the people accessing its online services, and cannot therefore be responsible for usurpation of the identity of a Client. If the Customer has reason to believe that a person is using his login details or his account, he must immediately inform SMEICORP.
6-1. Online credit card payment and Paypal
SMEICORP accepts payments only in EUROS by VISA, BLUE CARD and MASTERCARD, and by PAYPAL. To guarantee maximum security and reliability, we have chosen the secure PAYBOX VERIFONE payment interface, today the benchmark solution in the field of online transactions in France. The data relating to the Customer's bank card are encrypted using the following protocol Verifone Approvals and Certifications then transmitted to a French banking operator who decrypts them and manages the transaction. SMEICORP does not have access to the Customer's banking data.
Payment via Paypal is accepted insofar as the names of the Client and of the Paypal account holder are the same and insofar as the Paypal account is a verified account.
6-2. Cash payment by money order
SMEICORP only accepts cash money orders in EUROS issued by La Poste. The cash money orders is a simple and reliable means of remote payment. The Customer must fill in the form, specifying as beneficiary "SMEICORP", and send it to SMEICORP at the address listed at the top of this document.
6-3. Payment by bank transfer
SMEICORP only accepts transfers in euros, any additional costs related to the transfer being borne by the Client. Our bank details will be communicated to you upon request.
6-4. Default or late payment
In the event of non-immediate payment, the Customer must notify SMEICORP of his intention to pay for his order within 24 hours. The Customer has a period of 7 days from the order to send their payment to SMEICORP. At the end of this period, SMEICORP may cancel the order, without this cancellation being considered as a breach of the contract by its doing.
In addition, any late payment (non-provisioned account, repudiation of payment by bank card) will automatically entail, and without prior formality, the invoicing of late payment interest equal to one and a half times the current legal interest rate in France, without prejudice to all other rights and in particular the right to terminate this contract at the exclusive fault of the Client. The various costs which may result from an unpaid or partial payment are the responsibility of the Customer.
6-5. Invoice
The order form that the Customer establishes online does not constitute an invoice. The Customer will receive his invoice upon delivery. In addition, SMEICORP keeps a digital copy of each invoice accessible by the Customer by logging into their "Account".
Under the terms of law 80-335 of 12.05.1980, SMEICORP reserves the ownership of the Products delivered to the Customer until payment of the full amount of the order to SMEICORP. However, for the duration of the retention of title, the risks relating to the Products delivered, in particular, deterioration, loss or theft and any damage whatsoever will be fully borne by the Customer upon delivery.
8-1. Availability
The availability of Products is indicated on the Site for each Product in the form of options:
- The "in stock" option means that the Product is available and ready to be shipped.
- The "n days" option means that the Product will be dispatched with an additional average time of n days compared to a Product known as "in stock". - The option "on order" means that the Product will be ordered specially for the Customer according to his wishes (size, color, etc.) and an additional period is then given for information.
- The "unavailable" option means that the Product is temporarily not available for sale due to supplier shortage.
- The "sold out" option means that the Product is no longer available for sale.
8-2. Shipping and delivery times
SMEICORP undertakes to deliver to you within 30 days maximum from the day following that on which you transmitted your order to us (or of the receipt of your check or money order, if applicable). All other delivery times are given for information only.
However, the packaging of the order is usually done in 24 hours (working days) for a product "in stock" ordered before 11:30 GMT + 1 a working day, from the validation of payment, either:
- By bank card: immediate (except payment refused by the bank terminal),
- By Paypal,
- By postal money order: upon receipt of the money order.

Orders will reach the Customer in a solid, discreet package without any external mark identifying its content, only the sender "SMEICORP" will be mentioned.
9-1. Place of delivery
The Products are delivered to the delivery address indicated by the Customer, on behalf of the Customer, during the order procedure on the Site. Concerning the orders paid by Paypal, the protection of the purchases obliges us to send to an address registered on Paypal, consequently take care that the address chosen on the Site also appears on the Paypal account.
9-2. Absence on the day of delivery
Depending on the case, the carrier can leave a notice in the Customer's mailbox, inviting the latter to contact the Post Office or the depot closest to his home or to contact him to make a delivery appointment.
9-3. Late delivery
A package may not arrive within the time guaranteed by La Poste. In this case, the Customer must first contact their distributor post office or the Carrier and communicate to them the number of the parcel indicated in their "Account".
9-4. Loss of package
In the event of loss of a parcel, SMEICORP is required to respect the deadlines imposed by La Poste or by the carriers concerning the declaration of loss and the reimbursement of the shipment. In fact, the Customer is also bound by these deadlines. Consequently, the Customer has a maximum period of 10 working days from receipt of the email confirming the shipment of his package to declare it lost to SMEICORP. Beyond this period, no complaint will be taken into account. If the Customer has declared his lost package within the above-mentioned period, SMEICORP will be responsible for opening a complaint file. In this context, it is possible that the carrier requests SMEICORP of the documents necessary for the constitution of this file that the Customer undertakes now to provide him. The final responses concerning the surveys are given by the carriers within a period varying from one to three weeks. The response can be of two types: either the package is found and it is then returned to the customer according to the normal procedure, or the package is declared lost by the carrier and SMEICORP informs the Customer and proceeds to the refund (amount invoiced) or makes a second shipment at the Customer's choice.
9-5. Receipt of the package - Damaged or defective product
Any Product delivered must be subject to a check and possible reservations on the carrier's slip in the event of partial or total deterioration. Otherwise, the Product is deemed to be delivered in good condition and cannot be subject to any subsequent dispute. In addition, any damaged or defective Product must imperatively be reported the same day of receipt or at the latest the first working day following receipt, to SMEICORP customer service. The Customer will then receive a confirmation of the registration of this notification by email or sms. The Customer may then return, at his own expense, the damaged or defective Product, in its original packaging, with the original labels and the duly completed return slip, to the address appearing at the top of this document. Our customer service will then verify. If the Product has a manufacturing defect, it will be exchanged as soon as possible or refunded in the event of a stock shortage. The costs of resending a standard shipment will be reimbursed to the Customer, at the latest within fifteen days from the date of receipt of the return.
9-6. Delivery error
The Customer must make any complaint of non-conformity of the Products in kind, in quality or in quantity compared to the indications appearing on the invoice the very day of the reception or at the latest the first working day following the reception. Any complaint of non-conformity not made in the rules defined above and within the time limits could not be taken into account and will release SMEICORP from any responsibility towards the Customer. If a return is accepted, the Customer will receive a return number. The Product in perfect condition, in its original packaging, with the original labels and the duly completed return slip, will be returned to the address at the top of this document.
9-7.Package processing: UAA / Unclaimed / Refused
If your package is returned by our service provider for one of the following reasons:
- UAA (Undeliverable as Addressed),
- Parcel not claimed during its period of proceedings,
- Parcels refused by the recipient upon delivery,
after receipt and acceptance of return, we will issue a refund within 30 days, except for shipping costs.
10-1. Reminder of the applicable legal provisions
If for any reason whatsoever the Customer is not satisfied with the Product he has purchased, article L121-20 of the Consumer Code states that he has the possibility of renouncing his purchase within 14 days following receipt of his package.
In application of article L121-20-2, the right of withdrawal does not apply to software, video games, CD and DVD, VHS, if these have been unsealed, to Products made according to the specifications of the Client or clearly personalized or which, due to their nature, cannot be redirected or are liable to deteriorate or expire quickly. Customers who are resellers cannot benefit from the right of withdrawal. The Customer's declaration of withdrawal is made via the Withdrawal Form in pdf format made available to him at the time of the order and on his Online Account, Return section, by sending by post or parcel said withdrawal form to the address appearing at the top of this document, the postmark or the carrier's proof of the date of dispatch of the form.
10-2. Exclusions
The right of withdrawal cannot be exercised on the following Products:

10-3. Terms of exercise
The Customer is requested to indicate on the outside of the package the Order Number corresponding to the returned product and to send it within 14 days of exercising the right of withdrawal to the address at the top of this document. We ask the Customer to send us the product in its original packaging.
Subject to compliance with all of the conditions indicated above, a refund of the value of the Products in accordance with the purchase invoice, excluding shipping costs, will be made within 14 days of receipt of the Product by SMEICORP. In all cases, SMEICORP reserves the right to charge the price for Products consumed, damaged or missing.
The costs of returning the Product remain the responsibility of the Customer and, the parcel traveling under his responsibility, SMEICORP recommends him to request proof of deposit, to properly pack the product so that there is no deterioration related to transport , as well as insuring the package. SMEICORP cannot be held responsible for a loss of a package or for a problem of deterioration or malfunction caused during transport.
We do not have a Product exchange procedure for deliveries outside Metropolitan France
 
For delivery in France, within 7 days of receiving the package, the Customer may exchange the Product for the same Product (same reference) with different size characteristics and as far as the availability indicated on the Site.
The Product in perfect condition, in its original packaging, with the original labels must be returned to SMEICORP at the address listed at the top of this document.

13-1. Guarantees
The Products offered comply with the standards applicable in France.
